DO NOT misuse our products
Terra Blue is NOT responsible for misuse of our products. Be sure to keep all incense, oils, and other potentially dangerous items away from children and pets. Herbs, oils, resins and related organic and synthetic based products should not be orally ingested, sniffed, injected, smoked, or otherwise taken internally unless done as authorized by a licensed physician. We will not take any responsibility for an individual's personal decision to use our products in an illegal or damaging way. By placing your order with us, you, the customer, assume full responsibility for the use or misuse of our products.
Candles, incense, and charcoal should only be burned in appropriate sturdy holders on a stable and heat-resistant surface. Always keep burning items within your sight. Completely extinguish burning charcoal, incense and candles before leaving a room or going to sleep. Never burn items on or near anything flammable, including but not limited to drapes, bedding, carpets, and paper. Burning candles, incense & charcoal should be kept at least 3 feet away from anything that can burn. Do not place burning items where they can be knocked over by children, pets, or others. Keep burning items away from drafts, vents, ceiling vents and air currents that could blow papers, draperies or other lightweight items into the flame.
It is the responsibility of the buyer to ascertain and obey all applicable local, state, and federal laws in regard to purchase, possession and use of any item on this site. By placing an order, the buyer represents that the products ordered will be used in a lawful and responsible manner.
Legal Notice Regarding the Purchase of Athames, Bolines and Ritual Knives
Terra Blue only sells knives, also known as ritual athames and bolines, to individuals who can legally purchase and own such items in the particular jurisdiction where they reside. Your purchase of an athame from Terra Blue by telephone, by mail, by fax, over the internet or in person, legally binds you and your heirs, assigns, transferees, and personal representatives as follows:
When you order and purchase an athame from Terra Blue, you represent that you are of legal age to purchase the merchandise ordered and that the merchandise can be purchased and owned in your country, state, county, and/or city of residence. By offering athames for sale, Terra Blue does not represent or warrant that any specific purchaser may legally purchase, own, or possess the merchandise ordered. It is YOUR responsibility as the buyer to check your local laws.
Athames may be dangerous or even deadly if used improperly, negligently, and/or illegally. When you purchase an athame from Terra Blue, you agree that you will use the purchased merchandise in a safe and legal manner, consistent with all applicable laws, recognized safety rules, and common sense. You further agree that you will train and supervise minors in the use of the athame and that you will take such steps as may be reasonably necessary or required by applicable law to keep the athame out of the hands of minors and untrained and/or immature individuals.
When you purchase an athame from Terra Blue, you agree to assume all risks related to and/or arising from your ownership and use of the athame and agree to indemnify and hold Terra Blue harmless from any and all claims brought by any person or entity against Other Worldly Goods related to and/or arising from your ownership and/or use of the athame.
Debit & Credit Card Holds Due to AVS or CVV Failures
When using a debit or credit card on the site, the billing name & address provided during checkout MUST match the cardholder information on file with the cardholding institution. The 3 or 4 digit CVV/CCV verification code must also match the information on file for the card. If a debit card, credit card or check card is used to make a purchase on the Terra Blue website and the purchase is not accepted due to failed AVS address verification and/or CCV/CVV code verification, please be aware that most banks will hold the "authorized" funds (counting against your balance until the authorization clears or expires) even if your order was rejected by these security measures.
Terra Blue does not have the capability to release the bank's temporary hold on authorized funds and is not responsible for the policies of the customer's banking institution regarding temporary pre-authorization holds. Please note that authorization holds last for varying periods depending on the card issuing company's policy. The period may be as little as three days or as long as several weeks. These details are normally disclosed in the customer's cardholder agreement with the issuing company or bank. We suggest that the customer contact the issuing credit card company or bank directly in order to resolve these types of situations.
Undeliverable, Unclaimed & Refused Packages
If your order is returned to us as unclaimed, refused, or rejected, or if a package cannot be delivered because the shipping address you provided at the time of your order was incorrect, we will deduct the original shipping costs, any return shipping fees charged to us by the shipping company, and a 20% unauthorized return processing fee from any refund amount. If you request that we re-ship a previously undeliverable order, we will only do so after you pay for additional shipping fees to cover the repeat outbound shipment.
Typographical Errors
In the event that a product is mistakenly listed at an incorrect price, Terra Blue reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Terra Blue reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Terra Blue shall issue a credit to your credit card account in the amount of the incorrect price.
Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Terra Blue without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Terra Blue may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Terra Blue.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of North Carolina, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Terra Blue) shall be in the state or federal courts located in North Carolina. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Terra Blue products) must be commenced within one (1) year after the claim or cause of action arises. Terra Blue's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Terra Blue may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Terra Blue or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Terra Blue does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. Nonetheless, Terra Blue seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work)
